This Privacy Policy explains how Delta Tau Data Systems, Inc. of California (“Omron” “we,” or “us”) collects, uses, and discloses information about you. This Privacy Policy applies when you use our website located at https://forums.automation.omron.com/ (the “Site”), as well as our other websites, and other online products and services that link to this Privacy Policy (collectively, our “Services”), contact our customer service team, or otherwise interact with us. Unless otherwise stated herein, this Privacy Policy does not apply to information collected by (i) any third party (including our affiliates and subsidiaries); and (ii) Omron offline or through any other means. Some Omron affiliates’ sites and services (e.g., Omron.com, Omron247.com, Omronhealthcare.com, componets.omron.com, automation.omron.com) are governed by that Omron affiliate’s own separate privacy policies and practices. 

 

We may change this Privacy Policy from time to time. If we make changes, we will notify you by revising the date at the top of this Privacy Policy and, in some cases, we may provide you with additional notice (such as adding a statement to our website or sending you a notification). COLLECTION OF INFORMATION

Information You Provide to Us

We collect information you provide directly to us. The types of personal information we may collect include your name, email address, postal address, phone number, and any other information you choose to provide. For example, you share information directly with us when you create an account, interact with us on the Site, , fill out a form, submit or post content through our Site, , request customer support, or otherwise communicate with us. 

 

Information We Collect Automatically When You Interact with Us

We collect information automatically through your use of our Services. When you access or use our Services, we automatically collect certain information, including:

Cross-Device Tracking Use

We and our third-party service providers may use the information that we collect about you through your device(s) to identify other devices that you use (e.g., a mobile phone, tablet, other computer, etc.). 

 

SHARING OF INFORMATION

We share personal information in the following circumstances or as otherwise described in this Privacy Policy:

·       We share personal information with vendors, service providers, and consultants that need access to personal information in order to perform services for us, such as companies that assist us with web hosting and customer service.

·       If you submit a product review or post content in another public area of our Services, we share this information publicly on our Services.

·       We share personal information with third-parties for their own services and marketing purposes, you can opt out of this type of sharing by clicking the Cookies Settings.. California residents may also opt out by clicking the “Do Not Sell My Personal Information” link that is prominently displayed in our Site’s footer or the button below.

·       We may disclose personal information if we believe that disclosure is in accordance with, or required by, any applicable law or legal process, including lawful requests by public authorities to meet national security or law enforcement requirements.

·       We may share personal information if we believe that your actions are inconsistent with our user agreements or policies, if we believe that you have violated the law, or if we believe it is necessary to protect the rights, property, and safety of Omron, our users, the public, or others.

·       We share personal information with our lawyers and other professional advisors where necessary to obtain advice or otherwise protect and manage our business interests.

·       We may share personal information in connection with, or during negotiations concerning, any merger, sale of company assets, financing, or acquisition of all or a portion of our business by another company.

LINKS TO OTHER WEBSITES AND APPLICATIONS

The Site or our other Services may contain various links to, as well as plug-ins or widgets from, social media and other third-party websites or applications, which may provide additional information, goods, services, and/or promotions. 

 

ANALYTICS

We allow others to provide analytics services across the web. These entities may use cookies, web beacons, device identifiers, and other technologies to collect information about your use of our Services and other websites and applications, including your IP address, web browser, mobile network information, pages viewed, time spent on pages, links clicked, and conversion information. This information may be used by Omron and others to, among other things, analyze and track data, determine the popularity of certain content, and better understand your online activity.

Omron does not serve any advertisement, however, for your information, you may visit www.aboutads.info/choices for more information about interest-based ads and how to opt out of having your web browsing information used for behavioral advertising purposes.

 

California law permits residents of California to request certain details about how their information is shared with third parties for direct marketing purposes. For Canadian residents:

These third parties may use this information to provide you with behavioral advertising or other targeted content. You can opt-out of several third party ad servers’ and networks’ cookies simultaneously by using an opt-out tool created by the Digital Advertising Alliance of Canada or Network Advertising Initiative.  You can also access these two websites to learn more about online behavioral advertising and how to stop websites from placing cookies on your device. Opting out does not mean you will no longer receive online advertising. It does mean that the network from which you opted out will no longer deliver ads tailored to your web preferences and usage patterns.  We do not control these third parties’ tracking technologies or how they use them. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.

Additionally, we also work with third parties to serve ads to you as part of customized campaigns on third‑party platforms (such as Facebook and Instagram). As part of these ad campaigns, we or the third-party platforms may convert information about you, such as your email address and phone number, into a unique value that can be matched with a user account on these platforms to allow us to learn about your interests and serve you advertising that is customized to your interests. Note that the third-party platforms may offer you choices about whether you see these types of customized ads.

TRANSFERRING YOUR PERSONAL INFORMATION

Transfer not originating from the European Economic Area (“EEA”)

Omron has operations and service providers in the United States, Canada, and other countries, we will transfer and store your personal information that we collect or you provide to us in a third party server, outside of United States and Canada. We and our service providers may transfer your personal information to, or store or access it in, jurisdictions that may not provide levels of data protection that are equivalent to those in the United States and Canada. We will take steps to ensure that your personal information receives an adequate level of protection in the jurisdictions in which we process it. By using the Site or providing us with any information, you consent to the transfer to, and processing, usage, sharing and storage of your information outside the United States, Canada and in other countries, as set forth in this privacy policy.

If your personal information is originating from or processed in the EEA, please refer to the paragraphs “Legal Basis for the Processing” and “Transfers Outside the EEA” in the EU Addendum.

 

YOUR CHOICES AND UPDATING YOUR INFORMATION

Account Information

We will make a reasonable effort to ensure that your personal information used or disclosed by us is accurate and complete. In most cases, however, we rely on you to ensure that your information is current, complete, and accurate. Some of our Services may allow you to update your account information. If so, you may do so at any time by logging into your account or by  submitting your request through an online submission form. If you wish to delete your account, please submit your request through an online submission form, but note that we may retain certain information as required by law or for our legitimate business purposes.

 

If you demonstrate the inaccuracy or incompleteness of the information we maintain about you, we will assist you in updating the information as required. If appropriate, we will send the amended information to third parties to whom the information has been disclosed. When a challenge regarding the accuracy of personal information is not resolved to your satisfaction, we will annotate the personal information under our control with a note that the correction was requested but not made.

 

Cookies

Most web browsers are set to accept cookies by default. If you prefer, you can usually adjust your browser settings to remove or reject browser cookies. Omron does not send you any promotional emails at this moment. However, we may still send you non-promotional emails, such as those about your account or our ongoing business relations.

 

SECURITY AND RETENTION

Security of My Personal Information

We have implemented reasonable precautions to protect the information we collect from loss, misuse, and unauthorized access, disclosure, alteration, and destruction. Please be aware that despite our efforts, no data security measures can guarantee security completely. Although we do our best to protect your information, we cannot guarantee the security of your personal information transmitted through our Services. Further, we are not responsible for circumvention of any privacy settings or security measure we provide. Please take steps to protect against unauthorized access to your password, phone, mobile device, or computer by, among other things, signing off after using a shared computer or device, choosing a robust password that nobody else knows or can easily guess, and keeping your log-in and password private. We are not responsible for any lost, stolen, or compromised passwords or for any activity on your account via unauthorized password activity. Data Retention

We keep your personal information only for so long as necessary to fulfill the purposes for which it was collected and for other legitimate business purposes, including meeting our legal, regulatory, or other compliance obligations. Omron will retain your information indefinitely if it believes in good faith that we have a legal obligation to do so.

 

Users under 18

Our services are not designed for users under 18. If we discover that a user under 18 has provided us with personal information, we will delete such information from our systems.  If you believe we might have personal information from or about a user under 18, please contact us at the below number.  

ADDITIONAL INFORMATION FOR INDIVIDUALS LOCATED IN THE EEA (“EU ADDENDUM”)

This EU Addendum completes and supplements the front section of the Global Privacy Policy for information originating from or processed in the European Economic Area (“EEA”). In case of any contradictions between the front section of the Privacy Policy and the EU Addendum, the EU Addendum will have precedence.

The purpose of this EU Addendum is to provide the information required under the General Data Protection Regulation, applicable in the EEA as from May 25, 2018 (the "GDPR"), including the legal basis for processing your personal information, the retention of your personal information and your rights and our obligations are in relation to this processing.
DEFINITIONS

For the purposes of the EU Addendum, the following definitions shall apply:

Controller” generally means the legal entity that determines the purposes (i.e. why) and the means (i.e. how) of the processing of your personal information under this Privacy Policy, the Controller in this Privacy Policy is Omron.

Your Personal Information” means any information that constitutes “personal data” under the GDPR, namely any information relating to an identified or identifiable natural person.

Processor” means a natural or legal person that processes your personal information on behalf of the Controller. Omron’s processors may be Omron, affiliates or third-party service providers. Omron will conclude a data processing agreement with its Processors to ensure your personal information is processed in accordance with the GDPR.

 

LEGAL BASIS OF THE PROCESSING

The lawful basis for Omron’s processing of your personal information will depend on the purposes of the processing. For most personal information processing activities covered by this Privacy Policy, the lawful bases are:

·      We have obtained your prior consent;

·      The processing is necessary for Omron to perform our contractual obligations towards yu or to take pre-contractual steps at your request;

·      The processing is necessary to comply with our legal or regulatory obligation; or 

·      The processing is necessary for Omron’s legitimate business interests. 

More information

·      Processing on the basis of consent. Examples of processing activities for which 3m uses consent as its legal basis include:  collecting and processing precise location information from your mobile device; (ii) sending promotional emails when consent is required under applicable law; and (iii) processing personal data on 3m internet sites or apps through cookies and similar technologies when consent is required by applicable law.

·      Processing on the basis of performance of a contract. Examples of situations in which we process personal information as necessary for performance of a contract in which you use the Services provided by Omron.

·      Processing because Omron is under a legal obligation to do so. Examples of situations in which Omron must processes personal information to comply with its legal obligations include:  payment of taxes and other government levies; (ii) providing your personal information to law enforcement agencies and other governmental bodies when required by applicable laws; (iii) retaining business records required to be retained by applicable laws; and (iv) complying with court orders or other legal process.

·      Processing on the basis of legitimate business interests. When we process personal information on the basis that the processing is necessary for our legitimate business interests, such interests include:  providing, improving, and promoting Omron Services; (ii) communicating with current and potential customers, other business partners, and their individual points of contact; (iii) managing our relationships with our customers and other business partners, and their individual points of contact; (iv) other business development purposes; (v) sharing information within the Omron group, as well as with service providers and other third parties; and (vi) maintaining the safety and security of our products, services and employees, including fraud protection.

 

THIRD-PARTY RECIPIENTS

We may transfer your personal information to our employees (to the extent they need it to perform their tasks) and other Omron affiliates. Such other companies will either act as another controller (in which case you will be separately informed about this processing) or only process personal information on behalf and upon request of the Controller (thereby acting as a Processor).

In addition, we may also transfer your personal information to third party Processors that are not Omron affiliates to complete the purposes listed above, to the extent they need it to carry out the instructions we have given to them.

Such third-party Processors include:

·         our IT service providers, cloud service providers and database providers;

·         our consultants, suppliers and service providers that assist Omron in storing and analyzing the personal information; communicate with you on Omron’s behalf; and as otherwise necessary to provide services to you.

 

TRANSFERS OUTSIDE THE EEA

Your personal information transferred within or outside Omron may also be processed in a country outside the EEA. If your personal information is transferred outside the EEA, we will enter into EU standard contractual clauses approved by the European Commission prior to such transfer to ensure the required level of protection for the transferred personal information.

 

YOUR GDPR RIGHTS

You have a right of access to your personal information as processed by Omron under this Privacy Policy. If you believe that any information we hold about you is incorrect or incomplete, you may also request the correction thereof. Omron will promptly correct any such information.

You also have the right to:

·         request the erasure of your personal information;

·         request the restriction of the processing of your personal information;

·         withdraw your consent where Omron obtained your consent to process personal information (without this withdrawal affecting the lawfulness of processing prior to the withdrawal);

·         object to the processing of your personal information for direct marketing purposes (however, Omron does not engage in any direct marketing at this moment); or

·         object to the processing of your personal information for other purposes in certain cases where Omron processes your personal information on another legal basis than your consent. Omron will honour such requests, withdrawals or objections as required under the applicable data protection rules.

 

In addition, you also have the right to data portability. This is the right to obtain your personal information you have provided to Omron in a structured, commonly used and machine-readable format and request the transmission of such personal information to you or a third party, without hindrance from Omron and subject to your own confidentiality obligations. To exercise the above rights, please submit your request on the online submission form.

We will examine your question or complaint and get back to you as soon as possible.

 

You also always have the right to file a complaint with the competent data protection authority.

 

YOUR CALIFORNIA PRIVACY RIGHTS

The California Consumer Privacy Act or “CCPA” (Cal. Civ. Code § 1798.100 et seq.) and the Shine the Light law (Cal. Civ. Code § 1798.83) afford consumers residing in California certain rights with respect to their personal information. If you are a California resident, this section applies to you. This section of the Privacy Statement applies to information collected online and offline through or in connection with our Site, mobile applications, or other Services.

Do Not Sell My Personal Information

We do not sell your personal information for money but we and our business partners use tracking technologies to help us to understand our customers and visitors to the Services, to enhance your online experience, and to customize our offerings in ways that may be deemed a “sale” of personal information under the CCPA. This includes working with third parties such as that collect personal information via tracking technologies to provide us with data collection, reporting, and ad response measurement. To the extent we or our partners use such technologies on the Services, we offer a “Do Not Sell My Personal Information” opt-out (Cookies Settings), as discussed in the Analytics section above. If you elect to opt out, then we will notify third parties of your request.

 

We do not knowingly sell personal information about consumers under the age of 16.

 

Your Rights under the CCPA

Subject to certain limitations, you have the right to (1) request to know more about the categories and specific pieces of personal information we collect, use, disclose, and sell, (2) request deletion of your personal information, (3) opt out of any “sales” of your personal information that may be occurring, and (4) not be discriminated against for exercising these rights.

 

The rights to know and delete are subject to our being able to reasonably verify your identity and authority to make these requests. In order to verify your identity when you submit a request, we will ask you to provide two (2) or three (3) pieces of personal information to confirm in our records. For example, you will be asked to provide at least your name, address, email address and/or details of your recent interactions with us.

 

How to Submit a Request Under the CCPA

You may also authorize someone to exercise these rights on your behalf. In order to do so, we require signed permission. We will not discriminate against you if you exercise your rights under the CCPA.

Once we have a copy of the valid signed authorization, your designated representative/authorized agent will be able to exercise these rights with respect to the account(s) listed on such authorization for the life of the account, unless there is a specified term or expiration date on the authorization form. Any information gathered as part of the verification process will be used for verification purposes only. Responses to verifiable consumer requests will be delivered through secure email, depending on your election when you submit such requests.

Third Parties

Spam Defense
The IPS Spam Defense Service passes the email address and IP address of the registering member to the service to determine the likelihood a registering account is a spam source.
hCaptcha
We use the hCaptcha anti-bot service (hereinafter "hCaptcha") on our website. This service is provided by Intuition Machines, Inc., a Delaware US Corporation ("IMI"). hCaptcha is used to check whether the data entered on our website (such as on a login page or contact form) has been entered by a human or by an automated program. To do this, hCaptcha analyzes the behavior of the website or mobile app visitor based on various characteristics. This analysis starts automatically as soon as the website or mobile app visitor enters a part of the website or app with hCaptcha enabled. For the analysis, hCaptcha evaluates various information (e.g. IP address, how long the visitor has been on the website or app, or mouse movements made by the user). The data collected during the analysis will be forwarded to IMI. hCaptcha analysis in the "invisible mode" may take place completely in the background. Website or app visitors are not advised that such an analysis is taking place if the user is not shown a challenge. Data processing is based on Art. 6(1)(f) of the GDPR (DSGVO): the website or mobile app operator has a legitimate interest in protecting its site from abusive automated crawling and spam. IMI acts as a "data processor" acting on behalf of its customers as defined under the GDPR, and a "service provider" for the purposes of the California Consumer Privacy Act (CCPA).
